Terms of Use

Version 1 · April 2026

Before using Kobra Messenger, please read and accept the following terms. They define your relationship with BlackBeardAI, publisher of the application, and frame your use of the tool. These same terms appear inside the app before first use.

1. Terms of Service

Kobra Messenger is an end-to-end encrypted messaging application provided as is, without warranty of any kind. BlackBeardAI does not guarantee the absence of bugs, vulnerabilities, or service interruptions.

The application is distributed free of charge. Use is free within the limits of the laws applicable in your jurisdiction. BlackBeardAI is not party to communications exchanged between users and has no technical access to them.

2. Acceptable Use

You agree not to use Kobra Messenger to:

BlackBeardAI cannot technically monitor or control these uses — that is precisely the point of end-to-end encryption. Compliance with these rules is your exclusive responsibility.

3. Liability

Kobra Messenger is a communication tool. BlackBeardAI provides the software, not a centralized communication service.

BlackBeardAI disclaims all liability for:

End-to-end encryption protects your communications from third parties, but does not protect you against compromise of your device (virus, theft, unauthorized physical access). It is your responsibility to secure your device otherwise.

The application has not yet undergone an independent external security audit. As such, we do not recommend its use for communications where confidentiality is critical to your physical or legal safety.

4. Philosophy

Kobra Messenger exists to offer a private communication tool that does not depend on any central actor. The relay that forwards messages can be hosted by anyone — including you. No company controls your communications, reads them, or monetizes them.

This model is designed to support the confidentiality of journalists, whistleblowers, and activists; sensitive professional exchanges (medical, legal, industrial); and individual privacy in a world where it is increasingly eroded.

It is not designed as a tool to circumvent laws, but as a counterweight to mass surveillance and the advertising model of major platforms.

5. Your data

BlackBeardAI collects no personal data via Kobra Messenger. The application contains no advertising SDK, no analytics SDK, transmits no telemetry, and reports no automatic crash reports.

Everything stays on your device: your cryptographic identity, your contacts, your messages, your preferences. If you use a relay operated by a third party, that third party sees only encrypted bytes addressed to pseudonymous identifiers — they cannot read your messages or identify you.

If you operate your own relay, you alone see the connection metadata. See the self-hosting guide for best practices.

6. Applicable law

These terms are governed by French law. Any dispute relating to their interpretation or execution will fall under the jurisdiction of the competent courts. If a clause of these terms is found invalid by a court, the other clauses will remain in force.

7. Changes to these terms

These terms may evolve. In case of substantial modification, the application will present the acceptance screen again at its next launch, and you will need to re-accept to continue using it.
